I. Introduction

LAW on Modifications and Amendments to the Law on Federal Ministries and Other Organs of Federal Administration ( “Official Gazette of the Federation of Bosnia and Herzegovina “, No: 8/06 ) determines that Federal Ministry of Physical Planning performs expert and other tasks falling under the competence of the Federation of Bosnia and Herzegovina that relate to:
-    Planning and spatial planning; land utilization policy on federal level; preparation, implementation of the Spatial plan of the Federation
-    Harmonizing of cantonal spatial plans with the spatial plan of the Federation
-    long term development of the use of natural resources
-    geological researches
-    preparation of basic maps -geophysical, seismological, geometrical, minerogenetic, geochemical, geomorphologic and others
-     preparation of geologic basis for spatial planning
-     Monitoring relevant offices within the sector
-    Other tasks determined by the Law

II – NORMATIVE PART

1.    Modifications and Amendments to the Law on spatial planning and land utilization on FBIH level

Explanation
Modifications and Amendments to the Law on spatial planning and land utilization on FBIH level have been introduced for noticed legal gaps that required modifications and amendments to certain legal provisions to simplify their appliance. It also required harmonization in terminological sense between the names of the Ministry and provisions of the Law on federal ministries and other administrative bodies of the Federation

Explanation
Modifications and Amendments to the Law on implementation of the Decisions of the Commission to preserve national monuments as per Annex 8  of  the General Framework Agreement  for Peace in BIH have been introduced to simplify their appliance. Explanation
Provisions of the Law on modifications and amendments of the Law on selling public housing units that have tenancy right face certain deficiencies that relate to sale of nationalized and confiscated property. Therefore, modifications and amendments of the Law are required.

Explanation
Pursuant to the Art.19 and Art.23 par 1 of the Law on spatial planning and land utilization on FBIH , the FBIH Parliament is obliged to adopt spatial plans for the areas with specific characteristics and to make Decision on spatial plan preparation for the areas with specific characteristics. Hence, according to the FBIH Parliament’s decision on designated areas with specific characteristics in 2007,   it is necessary to make a Decision on spatial plan preparation and a Decision on designating areas of significance for the Federation

III – INFORMATIVE AND ANALYTICAL PART
l. “ Solid waste management” program
Activity plan 2007
Given the fact that additional credit funds of USD 8 million  cannot be withdrawn from the account, until the basic credit funds of  USD 18,0 million are spent. In order to achieve it, all necessary activities will be taken in 2007.
It is necessary to coordinate execution of works on construction of the landfill, equipment procurement, project documentation preparation etc. in the amount of USD 8.5 million.
Explanation
Law on modifications and amendments of the Law on federal ministries and other bodies of the federal administration (»Official Gazette of the Federation of BiH« No. 8/06) transformed Federal ministry of physical planning and environment into Federal ministry of physical planning and Federal ministry of environment and tourism. Federal Ministry of Physical Planning has reserved the right to withdraw credit funds from a special bank account at Uni kredit Zagrebacka bank  (credit funds for project implementation) ( in 2006).
However, Annex of the Budget 2007 of the Federation of BIH in its Chapter “ Developing project plan in the Federation of BIH, that are financed by INO loan and donor funds, defines  Solid waste management a project, whose carriers with regards to realization of loan and contribution  funds, i.g. Federation BIH participation in securing a part of funds for implementation of the respective project , are both Federal ministry of physical planning and Federal ministry of environment and tourism.
Although there  are different attitudes towards the responsibility of project implementation ( Federal ministry of physical planning considers appropriate that this Ministry continues project implementation, for it falls under the competence of the respective Ministry. It also provides several reasons such as: it is about selection of the most appropriate location for construction of landfills, and carrying out construction works regarding their construction; once they are built and become operational, environmental provisions will be applied.
